My site has a category structure with 3 levels and when creating search filter I have selected Hierarchical for the categories and certain level 2 themes are appearing as level 1. I cannot see a logical reason as some of the level 2’s that are appearing as level 1 have children and others do not. I’ve search and cannot see anyone else complaining of this issue so wondered if this is a know issue?

Its not a known issue – and certainly sounds odd..
I would recommend to do the usual – try another theme / disabling plugins to see if there is something interfering with how this works.

I tried all the normal disabling themes and plugins so I ended up installing your plugin on a vanilla site to make sure nothing else was affecting it but still had a hierarchy problem.
Looking at your code in class-search-filter-taxonomy-walker.php it seems where you are going through the category you make the decision about it’s level based on the previous category. This is where it can go wrong depending on the number of levels and the order in which they relate.
Below is an export of our taxonomy. If you import that into a vanilla site and then use your plugin you will see how many of the child cats display at the wrong level (example: ‘Conflict analysis’ should be a child of Conflict but appears as a top level).

If you look at the Filter By Date Tags combobox on this page http://turnoutthestars.org/search/ โ you can see that 1927, 1928, and 1929 are displayed at the top level, when they should be under 1920s (you can see that the count includes them), and 1934โ1938 should be under 1930s, as well.
What’s weird is that SOME of the sub-categories do appear at correct level of indentation.
